These Terms of Use ("Terms") govern your access to and use of Finds, the mobile application developed and operated by Mindeverse s.r.o. ("Finds", "we", "us", or "our"). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

APPLE NOTICE: You and Finds acknowledge and agree that (i) these Terms are concluded solely between you and Mindeverse s.r.o., and not with Apple Inc.; (ii) Mindeverse s.r.o., not Apple, is solely responsible for the App and its content; and (iii) Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary thereof.

2. Eligibility and Age Requirements

The App is intended for users aged 13 and over. By using the App, you confirm that:

• you are at least 13 years of age;

• if you are between 13 and 15 years of age (or under the age of digital consent in your jurisdiction), you have obtained verifiable parental or guardian consent to use the App and to the processing of your personal data as described in our Privacy Policy;

• if you are under the age of legal majority in your jurisdiction, your parent or guardian has reviewed and accepted these Terms on your behalf;

• you have the legal capacity to enter into a binding agreement.

We do not knowingly collect personal data from children under 13. If we become aware that a user is under 13, we will delete their account and associated data without delay. Parents or mguardians who believe their child has created an account without appropriate consent should contact support@thefinds.app immediately.

3. Account Registration and Security

To use Finds, you must create an account. You may register using an email address and password, or using Apple ID sign-in. No other registration methods are currently available.

By creating an account, you agree to:

• provide accurate, current, and complete information during registration;

• maintain only one account — one account per person is the rule. Creating multiple accounts to circumvent usage limits, free trial restrictions, or any other system is a breach of these Terms;

• keep your login credentials confidential and not share them with any third party;

• notify us immediately at support@thefinds.app if you become aware of any unauthorised access to your account;

• take full responsibility for all activity conducted under your account.

We reserve the right to suspend or terminate accounts that contain false information, that appear to have been created in violation of these Terms, or that are duplicates of an existing account.

4. Licence to Use the App

Subject to your compliance with these Terms, Mindeverse s.r.o. grants you a limited, non- exclusive, non-transferable, revocable licence to download and use the App on any Apple- branded device that you own or control, as permitted by the Usage Rules set forth in the Apple. Media Services Terms and Conditions.

Where applicable, this licence may be extended to other accounts associated with you via Apple Family Sharing or volume purchasing programmes, in accordance with Apple's applicable terms.

You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit or make available to any third party the App or your access to it. No other use is permitted without our prior written consent.

5. The App — What Finds Is and Is Not

Finds is an AI-powered visual fashion discovery app. The core function: you crop or photograph a clothing item, and Finds returns visually similar purchasable products with direct links to the original retailer's store.

Finds does not sell products directly. All purchases are made on third-party retailer platforms. We are not a party to any transaction between you and a retailer and accept no responsibility for those transactions.

We do not guarantee:

• that any specific product will be available for purchase;

• the accuracy of prices, availability, sizing, or product descriptions shown in the App — these are sourced from third-party retailers and may be outdated;

• that results will match your expectations or preferences;

• that links to retailer pages will always be active and functional.

All purchasing decisions are made at your own discretion and risk. We strongly recommend verifying product details on the retailer's own platform before completing any purchase.

6. Subscription Plans

6.1 Overview

Finds offers two plans: a Free Plan and a Pro Plan. Both plans include access to the core visual discovery feature. The distinction is in usage volume and access to additional features.

6.2 Free Plan

The Free Plan is available to all users at no cost and does not require a payment method.

Free Plan users may perform up to three finds per day. This allowance resets daily at midnight in the user's local timezone. Once the daily allowance is exhausted, no further finds can be performed until the reset. Free Plan users who wish to perform additional finds before the reset may purchase a Find Pack as described in Section 6.5.

Free Plan users may save up to three products to their Library. Once this limit is reached, no additional saves are permitted until the user upgrades to the Pro Plan or removes existing saved items.

The Free Plan does not include access to find history, the Discovery Feed, the For You Feed, or AI-powered features such as finding a product in a different brand or finding a cheaper alternative. Feed depth on the Free Plan is limited. These features are available exclusively to Pro Plan subscribers.

6.3 Pro Plan

The Pro Plan is a paid subscription that unlocks full access to all features currently available in Finds, with no daily usage caps.

Pro Plan subscribers may perform an unlimited number of finds per day. Pro Plan subscribers may save an unlimited number of products to their Library and have full access to their complete find history, the Discovery Feed, the For You Feed with no depth restriction, and all AI-powered features available in the App. The Pro Plan is ad-free. No additional purchases are required to access any feature included in the Pro Plan.

The Pro Plan is offered on two billing cycles:

• Monthly plan: $9.99 per month. Billing occurs on the same calendar date each month from the date the subscription begins. If that date does not exist in a given month, billing occurs on the last day of that month.

• Annual plan: $79.99 per year under standard pricing. A promotional introductory rate of $49.99 for the first year is available to a limited number of early subscribers at launch.

This promotional rate applies only to the first year of the subscription. Upon renewal, the annual plan renews at the then-current standard annual price. The promotional rate is not guaranteed to be available at any given time and may be withdrawn without notice.

Both billing cycles provide identical access to all Pro Plan features. The annual plan represents a lower effective monthly cost than the monthly plan.

6.4 Free Trial

New users who have not previously held a Pro Plan subscription are eligible for a seven-day free trial of the Pro Plan. The free trial requires no payment method at the time of activation.

During the trial period, the user has full access to all Pro Plan features.

If you do not subscribe to a paid Pro Plan before the trial period ends, your account automatically reverts to the Free Plan at the end of the seventh day. No charge is made. If you subscribe during or at the end of the trial period, billing begins from the date of subscription and the trial period is not counted toward the first billing cycle.

Each user is entitled to one free trial. The free trial is not available to users who have previously subscribed to the Pro Plan. Attempting to obtain additional free trials by creating multiple accounts or by any other means is a breach of these Terms and may result in immediate account termination.

6.5 Find Packs

Find Packs are one-time purchases available exclusively to Free Plan users. Pro Plan subscribers may not purchase Find Packs as they already have unlimited finds.

Find Packs provide a fixed number of additional finds that can be used immediately, regardless of whether the daily free allowance has been exhausted. Find Pack finds do not roll over to the following day and expire at the end of the calendar day on which they are purchased, based on the user's local timezone. Expired finds are not refunded.

One Find Pack is available at launch: five finds for $2.99. Additional pack options may be introduced in the future.

7. Billing, Cancellation, and Refunds

7.1 Payment Processing

All payments are processed exclusively through Apple's App Store payment system using your Apple ID. Mindeverse s.r.o. does not directly collect, store, or process your payment card details or billing information. By making a purchase, you also agree to Apple's applicable payment terms.

7.2 Auto-Renewal

Pro Plan subscriptions renew automatically at the end of each billing cycle unless cancelled by you before the renewal date. You will be charged the applicable subscription price at the start of each new billing cycle.

7.3 Cancellation

You may cancel your subscription at any time through your Apple ID subscription settings on your device. Cancellation takes effect at the end of the current paid billing period. You retain Pro Plan access until that date, after which your account automatically reverts to the Free Plan. No partial refund is issued for the remaining portion of the current billing period.

7.4 Refunds

Finds does not offer refunds directly. All refund requests are handled exclusively according to Apple's refund policy. To request a refund, contact Apple support through the App Store on your device. Downgrading from the Pro Plan to the Free Plan does not result in a refund for the remaining subscription period.

7.5 Price Changes

We reserve the right to change the pricing of the Pro Plan and Find Packs at any time. Existing subscribers will be notified of any price changes before they take effect and will not be charged the new price until their next renewal cycle following the notification. Continued use of the Pro Plan after a price change takes effect constitutes acceptance of the new price.

8. App Discontinuation

Mindeverse s.r.o. reserves the right to discontinue, suspend, or shut down the App or any feature of the App at any time, for any reason or no reason, and without prior notice, except where prior notice is required by applicable mandatory consumer protection law in your jurisdiction.

In the event of App discontinuation:

• We are under no obligation to provide any explanation, reason, or advance notice

beyond what is required by applicable mandatory law.

• No refunds will be issued by Mindeverse s.r.o. for any remaining subscription period, unused Find Packs, or any other paid feature. All refund rights are governed exclusively by Apple's refund policy and are handled solely through Apple.

• Since all payments are processed by Apple and not by Mindeverse s.r.o., any payment disputes or claims must be directed to Apple.

Why this clause exists: Finds operates in a dynamic environment. If circumstances require the App to be taken down — including at the request of a third party or due to regulatory requirements — we must be able to act immediately. Because all financial transactions are handled by Apple and not by us, we have no direct ability to issue refunds and this responsibility rests with Apple under their terms.

Nothing in this clause limits any rights you may have under mandatory consumer protection laws in your jurisdiction that cannot be excluded by contract.

9. Acceptable Use

By using the App, you agree to use it only for its intended purpose and in compliance with all applicable laws. You agree not to:

• use the App to photograph, record, or capture images of any person without their knowledge or consent for the purpose of identifying or locating their clothing or personal items — this is a specific and serious misuse of Finds that we prohibit absolutely;

• create multiple accounts to circumvent the one account per person rule, to obtain additional free trials, or to bypass any usage limitation;

• attempt to abuse, manipulate, or exploit the free trial system in any way;

• violate any applicable local, national, or international law or regulation;

• infringe the intellectual property rights, privacy rights, or any other rights of any third party;

• upload images that you do not have the right to use or that depict content that is illegal, harmful, or offensive;

• attempt to reverse engineer, decompile, disassemble, or extract the source code of the App;

• use automated tools, bots, scrapers, or scripts to access or interact with the App without our prior written permission;

• interfere with, disrupt, or damage the App's infrastructure, servers, or networks;

• use the App for any commercial purpose without our prior written permission, including reselling access to the App or its results;

• attempt to gain unauthorised access to any part of the App, our systems, or other users' accounts.

We reserve the right to determine in our sole discretion whether any use of the App constitutes a violation of these Terms.

10. Legal Compliance and Export Control

By using the App, you represent and warrant that:

• you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist-supporting country;

• you are not listed on any U.S. Government list of prohibited or restricted parties;

• your use of the App complies with all applicable laws and regulations in your jurisdiction.

11. Photos and Image Processing

When you use the visual discovery feature, you upload or capture a photo within the App. By submitting an image, you confirm that:

• you have the right to submit that image;

• the image was taken with the knowledge and consent of any person depicted in it, to the extent required by applicable law;

• submitting the image does not infringe any third-party rights.

We do not store your photos. Images are processed temporarily to generate a visual embedding used solely to return matching products. The original image is discarded immediately after processing. The embedding itself is also discarded after results are returned and is not stored in our database. For full details of how image data is handled, please refer to our Privacy Policy.

You retain full ownership of any image you submit. By submitting an image, you grant

Mindeverse s.r.o. a temporary, limited licence to process that image solely for the purpose of returning visual discovery results. This licence terminates immediately upon completion of the processing.

12. User Content

The App may include or introduce features that allow users to interact with content in ways visible to others, such as liking products (which may display aggregate like counts) or following brands (which may display follower counts). If and when such features are introduced, the following applies:

You retain ownership of any content you create or submit. By using interactive features, you. grant Mindeverse s.r.o. a non-exclusive, royalty-free, worldwide licence to use, display, and process your interactions (such as likes and follows) for the purpose of operating those features within the App.

You agree not to use any user-facing interactive features to post, submit, or display content that is unlawful, harmful, offensive, defamatory, or that infringes any third-party rights. We reserve the right to remove any content that violates these Terms.

13. Intellectual Property

All rights, title, and interest in the App, including but not limited to its design, branding, name, algorithms, software, visual embeddings pipeline, product matching system, content, and visual identity, are owned by or licensed to Mindeverse s.r.o. Nothing in these Terms grants you any ownership right or licence in the App's intellectual property beyond the limited use licencedescribed in Section 4.

You may not copy, reproduce, modify, adapt, distribute, sell, or create derivative works from any part of the App without our prior written permission.

You and Finds acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Mindeverse s.r.o., not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

Third-Party Terms: When using the App, you must comply with applicable third-party terms of agreement. Your use of the App is subject to the Apple Media Services Terms and Conditions and App Store Usage Rules, which are incorporated into these Terms by reference. You must not be in violation of any applicable third-party service agreements when using the App.

14. Third-Party Services and Links

The App integrates with or links to third-party services and retailer platforms. We are not responsible for the content, availability, pricing, privacy practices, or terms of any third-party platform. Accessing third-party retailer pages through the App is done at your own risk. We strongly encourage you to review the terms and privacy policies of any third-party platform you interact with.

Third-party services used to operate the App include Apple Inc. (App Store, payment processing, Apple ID authentication, Apple Vision), Supabase Inc. (database and backend infrastructure), HuggingFace Inc. (AI model hosting), and Resend Inc. (email delivery). Full details are set out in our Privacy Policy.

15. Maintenance, Support, and Warranties

Mindeverse s.r.o. is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and Finds acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

Mindeverse s.r.o. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed below.

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or available at all times; that visual discovery results will be accurate, complete, or meet your expectations; or that product availability, pricing, or descriptions sourced from third-party retailers will be accurate.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Mindeverse s.r.o.

16. Product Claims

You and Finds acknowledge that Mindeverse s.r.o., not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including but not limited to:

• product liability claims;

• any claim that the App fails to conform to any applicable legal or regulatory requirement;

• claims arising under consumer protection, privacy, or similar legislation.

Apple has no obligation or liability with respect to any such claims. Nothing in these Terms limits Mindeverse s.r.o.'s liability to you beyond what is permitted by applicable mandatory law.

17. Limitation of Liability

To the maximum extent permitted by applicable law:

• we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App;

• we shall not be liable for any purchasing decisions made through third-party retailer platforms accessed via the App;

• we shall not be liable for any loss resulting from App discontinuation, suspension, or shutdown;

• we shall not be liable for expired Find Pack finds or any unused portion of a subscription following account termination or App discontinuation;

• our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim, or USD 10, whichever is greater.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable mandatory law, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.

Apple has no liability whatsoever with respect to any claims relating to the App.

18. Indemnification

You agree to indemnify, defend, and hold harmless Mindeverse s.r.o. and its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• your use of the App in violation of these Terms;

• your violation of any applicable law or regulation;

• your infringement of any third-party rights, including intellectual property rights or privacy rights;

• any image or content you submit through the App;

• your creation of multiple accounts or abuse of the free trial system.

19. Account Suspension and Termination

19.1 Termination by Us

We reserve the right to suspend, restrict, or permanently terminate your account and access to the App immediately and without prior notice if we reasonably determine that you have:

• violated any provision of these Terms;

• engaged in fraudulent, abusive, or deceptive activity;

• created multiple accounts or abused the free trial system;

• used the App to photograph or capture images of any person without their consent for the purpose of identifying their clothing or personal items;

• misused, exploited, or attempted to circumvent the subscription or Find Pack systems;

• created a security, legal, or reputational risk for Mindeverse s.r.o. or other users.

Upon termination for any breach of these Terms, your access to the App ceases immediately. You will lose access to all features, including any active Pro Plan subscription, unused Find Pack finds, and your saved Library. No refund will be issued by Mindeverse s.r.o. for any remaining subscription period or unused purchases. Any refund entitlement is governed solely by Apple's refund policy.

19.2 Termination by You

You may delete your account at any time through the App settings. Account deletion takes effect promptly. Your personal data will be handled in accordance with our Privacy Policy.

Subscription cancellation is separate from account deletion and must be managed through your Apple ID settings to avoid further charges.

20. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Czech republic, without regard to its conflict of law provisions.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Czech Republic, unless mandatory consumer protection laws in your jurisdiction require otherwise. If you are a consumer resident in the EU, you may also be entitled to bring proceedings before the courts of your country of residence.

EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform accessible at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings but will consider reasonable requests.

21. Force Majeure

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, internet or infrastructure outages, third-party service failures (including AI model providers, cloud infrastructure, or payment processors), government actions, legal or regulatory requirements, or any other event of force majeure. In such circumstances, our obligations will be suspended for the duration of the event.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, applicable law, or our business practices. For material changes, we will provide reasonable advance notice via in- app notification or email before the change takes effect, where required by applicable law.

The "Last updated" date at the top of these Terms indicates when they were most recently revised. Your continued use of the App after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and may delete your account.

23. Apple App Store Specific Terms

The following terms apply specifically to your use of the App downloaded from the Apple App Store:

• These Terms are between you and Mindeverse s.r.o. only, and not Apple.

• Apple has no obligation to provide any maintenance or support services for the App.

• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.

• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary thereof.

• You must comply with the Apple Media Services Terms and Conditions and App Store Usage Rules when using the App.

• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

24. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mindeverse s.r.o. regarding your use of the App and supersede all prior agreements, representations, or understandings.

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity or enforceability of the remaining provisions.

No Waiver: Our failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any future occasion.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Language: These Terms are provided in English. In the event of any conflict between a translated version and the English version, the English version shall prevail.

Notices: All notices to us should be sent to support@thefinds.app. Notices to you will be sent to the email address associated with your account or delivered via in-app notification.
